Tower Siting and Infrastructure

Wilkinson Barker has a leading communications tower siting and infrastructure practice.  Such facilities are critical to the provision of new and enhanced services.  The firm’s attorneys counsel a wide range of licensees, applicants, and tower owners on requirements affecting the construction and installation of such facilities, including environmental, historical and Tribal matters.  The firm also represents trade associations on tower siting issues.

The firm’s attorneys have extensive experience helping clients to comply with the requirements imposed by the FCC and other federal, state, and local agencies and officials in this area.  Our work includes strategic advice and counseling, meeting with officials, development of compliance plans, obtaining necessary authorizations, and representing clients in enforcement proceedings.

Wilkinson Barker also assists clients in regulatory policy proceedings and appeals related to tower siting, including FCC proceedings concerning migratory bird issues, tower lighting requirements, emergency power provision, RF matters, and access to pole attachments.  The firm also has experience regarding the proper balance between federal policies favoring deployment, on the one hand, and state and local zoning restrictions, on the other.

Transactions involving towers and other communications infrastructure also present important regulatory considerations.  The firm’s commercial and transactional attorneys assist clients regarding these relevant obligations when they engage in mergers, acquisitions, and other business transactions.
